1. About these terms

These terms govern your use of capstonetek.com (the "site") and set out the general framework for the supply of Capstone Tek products and services. "We", "us" and "our" mean Capstone Tek of 3510 Hobson Road, Suite #204, Woodridge, IL 60517, USA. "You" means the person or organisation using the site or engaging us.

By using the site you accept these terms. If you do not accept them, please do not use the site.

2. Information on this site

We take care to keep the site accurate, but it is published for general information. Specifications, compatibility notes, timelines and prices shown here are indicative and may change without notice.

Prices shown on the pricing page are indicative starting points only and are not an offer. A binding price exists only in a written quote or order confirmation issued by us for your specific project.

Statements about smartphone compatibility, read range and tag performance reflect typical conditions. Real-world performance depends on the handset, the case, the surface the tag is mounted on and the environment. We confirm expected performance for your specific application as part of the quoting process, and where it matters we test against a physical sample you supply.

3. Orders, quotes and payment

• A quote is valid for the period stated on it, or 30 days if no period is stated.
• A contract is formed when you accept a quote in writing or pay a deposit against it, whichever happens first.
• Changes to scope after acceptance are agreed in writing and may affect price and timeline.
• Payment terms, deposits and milestones are as stated in the quote.
• Prices exclude applicable sales tax, duties and shipping unless the quote says otherwise.

4. Artwork, proofs and your responsibilities

You are responsible for supplying artwork, content, links and data in the agreed formats, and for confirming that you hold the rights to use everything you supply. You are responsible for checking and approving proofs. Once a proof is approved, production proceeds on that basis and we cannot accept responsibility for errors contained in the approved proof, including spelling, contact details, destination URLs and colour expectations that were visible at proofing.

Where physical samples are offered, we recommend taking them. Rejecting a sample stage is your decision and shifts the associated risk to you.

5. Hosted pages and subscriptions

Where your project includes pages hosted by us, those pages are provided for the subscription period stated in your quote. We aim for continuous availability but do not guarantee uninterrupted service; maintenance windows and provider outages happen. If a subscription lapses, hosted pages may be suspended, and tags pointing at them will no longer resolve to your content. We will give reasonable notice before suspension.

You own your content and your data. On request at the end of an engagement we will provide an export of the content and any captured records, and delete our copies after an agreed period.

6. Acceptable use

You must not use the site, our products or any page we host for you to:

• break any applicable law or regulation;
• misrepresent the origin, authenticity, composition or safety of a product;
• infringe anyone's intellectual property, including by applying another party's branding to hardware we produce;
• collect personal data without a lawful basis or an appropriate notice;
• breach the published policies of any review platform, including by offering incentives for reviews or screening customers by sentiment before showing a public review link;
• distribute malware, attempt to gain unauthorised access, or interfere with the operation of the site.

We may suspend or terminate a service that is being used in breach of this section, and we reserve the right to decline work we consider deceptive.

7. Intellectual property

The site and its content — text, design, code, graphics and the Capstone Tek name and marks — belong to us or our licensors and may not be copied or reused without permission, beyond ordinary personal or internal business reference.

You retain ownership of your own trade marks, artwork and content. You grant us a licence to use them only as needed to produce and support your project. On full payment, you receive the rights to the deliverables set out in your quote. Underlying tools, templates, code libraries and know-how we use to produce the work remain ours.

Third-party names mentioned on this site — including Google, Trustpilot, Tripadvisor, Yelp, Facebook, Apple, Android and NXP — are the trade marks of their respective owners. Reference to them is descriptive and does not imply any partnership, sponsorship or endorsement.

8. Warranties and limits

We warrant that we will supply services with reasonable skill and care, and that hardware will be free from material manufacturing defects at delivery. Faulty hardware reported within the period stated in your quote will be replaced.

We do not warrant that NFC tags will read on every device in every circumstance, that any particular rate of verification, review generation, lead capture or RSVP will be achieved, or that a third-party platform will continue to operate, permit, or deep-link in the way it does today.

Except where liability cannot lawfully be excluded, and to the maximum extent permitted by law: the site is provided "as is"; we exclude implied warranties of merchantability and fitness for a particular purpose; we are not liable for indirect, consequential or special loss, loss of profit, loss of business, loss of goodwill or loss of data; and our total liability arising from any engagement is limited to the amount you paid us for that engagement.

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

9. Third-party links and services

The site links to third-party sites and services we do not control. We are not responsible for their content, availability or practices, and a link is not an endorsement.

10. Privacy

Our handling of personal information is set out in our Privacy Policy, which forms part of these terms.

11. Changes

We may update these terms. The version published here when you use the site is the version that applies. Changes do not affect contracts already formed.

12. Governing law

These terms and any dispute arising from them are governed by the laws of the State of Illinois, United States, and the courts of Illinois have exclusive jurisdiction, without affecting any mandatory consumer rights you have under the law of your own country of residence.
